Public interest litigation has played an important role in advancing human rights and social justice. With the efforts and involvement of NGO sectors and lawyers, this litigation has also broadened the judiciary’s role in public policy implementation, which may compel the resistant government or agencies to take actions. Thus, it is imperative for law school students to study the public interest litigation and how its strategy applied in various social issues.
This public law case seminar is co-taught by Visiting Professor Serge A. Martinez and Professor Wen-Chen Chang. In this semester, we shall focus on several constitutional litigation and controversies in Taiwan and ask students to analyze issues involve and develop effective strategies for litigation as well as public advocacy.
The cases we shall focus include 1) the Shih-Lin Wang Family taking case, 2)gay marriage and 3) death penalty, along with others. During the course discussion, practicing lawyers and representatives from nongovernmental organizations who are involved in the cases and controversies will be invited to the class for lecture and further interactions with students.


本學期的公法實體程序綜合研討將由瑪舍琦訪問教授及張文貞副教授共同開設。本課程將以英文授課，有需要時則會輔以中文說明。本學期將以台灣近年重大的憲法及人權案例為討論對象，授課同學除了必須瞭解相關爭議外，還必須進一步研擬可行的訴訟及社會說服策略。本學期的議題將包括1)士林王家的都更爭議、2)死刑、及3)同志婚姻或伴侶權。學期進行中，相關案例的訴訟律師及公益團體將被邀請到課堂上演講，與修課同學做進一步的互動及討論。
